3.01 CHARTER PRICE – DEFINED. Except as otherwise provided in this Agreement, the charter price set forth herein includes all costs of operating the aircraft on the specified route, as well as ancillary costs such as fuel, on-board supplies and catering, passenger and aircraft ground handling, aircraft maintenance, navigation and overflight costs, airport costs, crew costs (including salaries, per diems, hotel and ground transfers), carrier liability and full insurance coverage as well as taxes and charges, with the exception of those levied and levied by individual passengers. The charter price does not include (i) U.S. domestic transportation taxes, U.S. sector taxes, U.S. security fees, U.S. international departure taxes, U.S. international arrival taxes, U.S. customs user fees, U.S. immigration fees, U.S. immigration fees. A deviation from the itineraries or services agreed at the request of the CHARTERER may result in an increase in the price of the charter. If the operation of the flight is prevented or delayed by the charterer or a person acting on its behalf, including (but not limited to) a passenger arriving more than 20 minutes before the scheduled departure time, the charter price will remain payable and the carrier may, in its sole discretion and without any liability, depart at the scheduled time or delay the flight. In this case, the charterer will be countered with a daily rate of two and a half hours of flight at the current charter price of the aircraft. 5.10 FORCE MAJEURE. Except as otherwise provided in this Agreement and subject to compliance with applicable laws, regulations and contracts, the provision of conveyances under this Agreement is subject to the following conditions: force majeure; quarantine restrictions; fire; fog; flooding; weather; closure of the airport; damage or destruction of aircraft that is not caused by the CARRIER or its employees or agents; unavailability of fuel; riots or civil unrest; war or dangers or dangers that occur in a state of war; or any other act, matter or object beyond the control of the CARRIER that prevents, delays or interrupts the supply, operation or performance of such transport (individually and collectively referred to as “Force Majeure”). In the event that force majeure results in the cancellation of a flight, the CARRIER will refund the amount paid for the cancelled air transport. In addition, the CARRIER, in coordination with the CHARTERER, will do its best to divert Passengers affected by a case of force majeure via other air services or other means of transport. If a cancellation caused by force majeure requires the Carrier to carry aircraft in order to provide the service for the charterer`s next flight, the CARRIER and the CHARTERER agree to share the cost of that ferry flight equally; It is agreed that this costs ninety-five percent (95%) of the one-way charter price between the affected points. 3. Costs and expenses: The rental offer for each individual trip determines the charter price and all associated costs and expenses for each individual charter.
The Customer is responsible for all additional costs incurred by JetsetPrivate Air to provide the services described in this Agreement and the Customer may be invoiced separately or such costs and expenses may be added to the prices of the Charter Offer (if known at the time of execution of the Charter Offer); These additional costs and expenses include, but are not limited to, food costs, ground transportation costs, air telephone costs, de-icing costs, fuel surcharges, crew costs, air navigation fees, weather service fees, international fees and other costs and expenses associated with charter services. Customer further agrees to be responsible for all sales, uses, VAT, stamps, FET, transfers, segment fees and other similar taxes, fees, duties and penalties that may be imposed by federal, state, county, local, foreign or other government agencies as a result of flights and services provided under this Agreement (“Taxes”). In the event that government agencies increase these taxes and fees and duties, you may have to pay increased amounts that have not yet been collected. The Customer shall defend, indemnify and hold JetsetPrivate Air harmless from any and all liability for any taxes that are Customer`s obligation under this Agreement. Customer`s obligations under this Section shall survive the termination of this Agreement. 2.12 UNUSED STORAGE SPACE. In the event that a space at the disposal of the CHARTERER remains unused at the time of departure, the CHARTERER accepts the use of this space by the CARRIER without refund or reduction of the price of the charter, but only for the transport of the personnel and goods of the CARRIER. The carrier`s performance of any flight provided for herein is subject to the timely issuance of the permits, authorizations, permits and operating authorizations required by any government, government agency or airport authority to operate such flight, including, but not limited to, the required landing, transit, overflight and lifting fees. If, despite the carrier`s timely efforts, a government, government agency or airport authority fails to issue or issue the permits, permits, permits or operating authorities referred to herein in a timely manner prior to the scheduled departure to reasonably enable the carrier to make the necessary flight arrangements, or is required to revoke or revoke them after they have been issued, the carrier may choose to: terminate this Agreement with respect to the flight(s) concerned without liability for penalties or damages. In the event of such termination, the CARRIER shall immediately reimburse all amounts received from the CHARTERER, with the exception of the part of the Charter Price attributable to the carriage already performed by the Carrier and the remaining carriage performed by the Carrier or by another Carrier on the instruction of the Carrier. 3.03 ANTI-ICING/DEFROST COSTS. A fee in addition to the charter price specified in this Agreement shall be charged by the Carrier to the CHARTERER in the amount of fifty (50) percent of all ground de-icing/de-icing costs incurred by the Carrier to operate flights under this Agreement.
